Terms and Conditions: This Terms and Conditions Agreement ("Agreement"), effective as of the date access is granted to the databases of Info To Go® Navigating the Internet, ("Info To Go"), is agreed to, by reference, between Garten Publications Inc dba Info To Go and the institution, organization or individual subscribing to online access. This Agreement, as applicable, applies to individual subscribers and to multi-user subscribers without regard to how such subscriber accesses publisher's databases. Service: Info To Go is a product that provides hyperlinks to pre-selected Internet resources that contain pre-screened, quality information on selected topics. Well over 400 resource links are regularly added each month. Additionally, links to many resources considered of "special and timely interest" are periodically added during each month. Included are advanced database search, preview and print features. Authorized Users: Subscribers and its users who are permitted to access the service pursuant to a subscription but within the limitations applicable to the subscription level. All users, whether local or remote, shall be required to submit to a subscriber's user authentication process or to Info To Go's authentication process to ensure that all users have a right to connect to the publisher's databases. Electronic Edition Subscription: A subscription that provides access to content added to the publisher's databases from the beginning date to the end date of a subscriber's subscription period but which does not include "special and timely interest" resources periodically added during each month. An Electronic Edition subscription may be purchased without access to archive information. Electronic Edition Subscription plus Archives: A subscription that provides access to the publisher's entire database of resources. In addition to any current issue, this includes access to resources from prior printed and electronic issues back to January 2004. Access to archives may not be purchased without an Electronic Edition subscription, either individual or multi-user. Usage Rights: Info To Go grants to a subscriber the non-exclusive and non-transferable right for it and its authorized users to access service on its servers, upon payment of a subscription fee and subject to this Agreement. This access right allows users to view, search, retrieve, display, and print output and to "click-thru" to any hyperlinked resources contained in the publisher's databases. Access rights do not include the right to redistribute all or any part of the service content to third parties unless specifically permitted in this Agreement. Subscribers and authorized users acquire no ownership rights to any information provided by a subscription, to the proprietary software, or to documentation provided to assist in accessing the service. Notwithstanding anything to the contrary in this Agreement, no term or provision of this Agreement shall be interpreted to limit or restrict the rights of a subscriber or its authorized users, including fair use rights, provided by U.S. Copyright Law or other applicable intellectual property laws. Prohibited Uses A subscriber and its authorized users may not: Make local electronic copies of all or any part of the publisher's database contents beyond what is required for normal functioning of Web browser software. Distribute all or any part of the database contents to anyone other than the subscriber and its authorized users. Permit access to the publisher's databases by persons or organizations who are not authorized users. Engage in activity that may burden publisher's servers, such as computer programs that automatically download content, commonly known as web robots, spiders, crawlers, wanderers or accelerators, or any other such program that might be used for this function. Warranties While Info To Go has attempted to minimize inaccuracies in its data, it is being provided "AS IS". All resource links are verified by its staff prior to entry onto its servers and database entries are periodically checked by a link checker and, when required, are either updated or deleted. The publisher assumes no responsibility whatsoever for losses of any kind related to use of its service. Subscribers hereby acknowledges that use of the publisher's databases is at subscriber's sole risk.
